 Pwede ko pa ba kasuhan ng cyber libel ang basher ng business ko?


Can I file for Cyber Libel kahit na 3 years ago pa ang post and deleted na? May basher ako online saying na fake daw yung mga sabon ko and that my business is a scam? Last week ko lang nakita itong post, ang dami na palang shares at likes. Can I still sue?


Yes, you can still file a complaint for cyber libel kahit na ang prescriptive period ay one year. In the recent ruling of the Supreme Court in 2024, in Hernandez vs. Causing, the prescriptive period for Cyber Libel is one year, one year from the date of posting or from the discovery of the complainant.


Ibig sabihin since last week mo lang nakita ang libelous post, magsisimula pa lang ang one year period mo to file the case kahit na 3 years ago pa yung posting pero ngayon mo lang or last week mo lang na discover. 


Ang sabi ng Korte Suprema, pwede ka pa ring mag-file ng case. As to the 2nd question, yes you can still file a case even if yung basher mo subsequently deleted the post as long as you have the screenshots and other pieces of evidence that will prove the the post was published online. Ayon sa Korte Suprema, ang ebidensya kagaya ng screenshots, shared post, at witnesses ay pwedeng gamitin upang patunayan the meron ngang defamatory statement.


So go ahead fight for your rights, ipaglaban mo ang reputasyon at magandang pangalan mo at nang iyong negosyo.
